## Agreement to Terms By downloading, accessing, or using the Vantage app or website (vantagephotoapp.com), you agree to be bound by these Terms of Service. If you do not agree, do not use Vantage. --- ## Eligibility You must be at least **13 years old** to use Vantage. By creating an account, you confirm that you are 13 or older. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. --- ## Your Account You are responsible for: - Keeping your password secure and not sharing it - All activity that occurs under your account - Providing accurate information when creating your profile If you suspect unauthorized access to your account, contact us immediately at support@vantagephotoapp.com. --- ## User Content ### What you own You retain ownership of all photos, reviews, scout reports, and other content ("User Content") you submit to Vantage. ### License you grant us By submitting User Content to Vantage, you grant us a **non-exclusive, worldwide, royalty-free license** to display, reproduce, and distribute that content within the Vantage app and website for the purpose of operating the service. This license ends when you delete your content or account, except for content that other users have interacted with (such as reviews on a location), which may be retained in anonymized form. ### Your responsibilities You represent that: - You own or have the necessary rights to the content you post - Your content does not infringe any third party's intellectual property, privacy, or other rights - Your content complies with these Terms and all applicable laws --- ## Content Standards Vantage is a photography location scouting community. All content you post — photos, reviews, scout reports, captions, and profile information — must meet the following standards. ### Prohibited content You may **not** post content that contains: - **Nudity or sexual content** — including explicit or implicit nudity, sexually suggestive imagery, or content that sexualizes any person - **Graphic violence** — including gore, gratuitous depictions of injury, death, or cruelty to people or animals - **Child sexual abuse material (CSAM)** — any sexual content involving minors is strictly prohibited and will be reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement - **Hate speech** — content that attacks or dehumanizes individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin - **Harassment or threats** — content designed to intimidate, bully, or threaten any individual - **Misinformation** — deliberately false location information, fabricated scout reports, or fake reviews Vantage is intended for photography-related content only. Off-topic, promotional, or spam content is not permitted. ### Reporting and enforcement Users may report content that violates these standards using the in-app report feature. We review reports and will remove violating content and suspend or terminate the accounts responsible. Repeat violations result in permanent bans. We cooperate fully with law enforcement where required by law. --- ## Prohibited Conduct You agree not to: - Post content that violates the Content Standards above - Impersonate another person or misrepresent your affiliation - Scrape, crawl, or systematically extract data from Vantage without written permission - Attempt to gain unauthorized access to any part of the app or its infrastructure - Use Vantage to distribute spam or unsolicited messages - Post false or misleading location information or scout reports - Violate any applicable local, state, national, or international law We reserve the right to remove content and terminate accounts that violate these rules. --- ## Premium Subscription Vantage offers a premium subscription that unlocks additional features. ### Pricing - **Monthly:** $9.99 / month - **Annual:** $99.99 / year (approximately 17% savings) - **Beta testers:** The first 100 beta participants receive free lifetime access to all premium features ### Billing Premium subscriptions are billed through Apple's App Store (In-App Purchase). Your subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your iPhone's App Store settings. ### Refunds Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly. ### Changes to pricing We may change subscription pricing with reasonable advance notice. Price changes will not affect your current subscription period. --- ## DMCA / Copyright Takedown Policy We respect intellectual property rights. If you believe that content on Vantage infringes your copyright, please send a notice to **dmca@vantagephotoapp.com** that includes: 1. A description of the copyrighted work you claim has been infringed 2. A description of where the infringing content appears in Vantage 3. Your contact information (name, email, phone, address) 4. A statement that you have a good faith belief the use is not authorized 5. A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf 6. Your physical or electronic signature We will review and respond to valid DMCA notices promptly. Repeat infringers will have their accounts terminated. --- ## Location Data and Safety Vantage is a tool for scouting photography locations. When visiting locations discovered through the app: - Always check current conditions, permits, and access rules before visiting - Respect private property and posted signage - Follow all applicable laws, including wildlife protection regulations - Vantage does not verify that locations are safe, accessible, or legally accessible to visit You assume all risk associated with visiting any location. --- ## Termination We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time through the app settings or by contacting support@vantagephotoapp.com. --- ## Disclaimers Vantage is provided **"as is"** without warranties of any kind, express or implied. We do not warrant that: - The service will be uninterrupted or error-free - Location data, sun/moon calculations, or community content are accurate or complete - Any specific location is safe, accessible, or legally open to the public --- ## Limitation of Liability To the maximum extent permitted by law, Vantage shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the app, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of Vantage shall not exceed the amount you paid to us in the 12 months preceding the claim. --- ## Governing Law These Terms are governed by the laws of the State of **Colorado**, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Colorado. --- ## Changes to These Terms We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "last updated" date.
